These terms and conditions are subject to change without warning. Please review this page each time you are commissioning me.
-
I retain the rights to every image I produce.
-
My commissions are for "Personal Use" only unless otherwise discussed. Emotes are commissioned for use as emotes on streaming platforms and/or Discord. Beyond this, you are not allowed to profit off the commissioned piece unless properly discussed beforehand.
-
My clients/commissioners DO NOT have the right to mint/sell their commissions as NFT. Doing so is in violation of these terms and all rights you have to your work will be revoked.
-
My clients/commissioners DO NOT have the right to use their commissions for AI artwork. Doing so is in violation of these terms and all rights you have to your work will be revoked.
-
I will not create NFTs.
-
Any commissions or art I create may not be used for NFTs nor AI in any form.
-
When sending a pose reference, please keep in mind that it will be made through my personal artistic interpretation and I will not copy the exact pose/linework of the reference.
-
Please review my portfolio and my style prior to commissioning; my style is fairly broad in what I am capable of, but I will not copy another artist's style for you.
-
When commissioning me, if I have made an emote in a style you like or would prefer to have your emotes designed in, please send me a picture alongside of your commission so I know what you are interested in.
⤹ (additionally: When commissioning emotes of, for example, your fursona, you can let me know if you'd like me to draw it in my animal style as represented through my shops, or more similarly to your model and/or reference sheet provided. You can also choose whether I use your character's eye style, or if you'd like me to use my own (also represented in my shop.) If this is not specified, I will do whichever I feel fits your emotes best in my artistic opinion. You are welcome to ask me to change these to the other, but only during the sketching stages.) -
All completed commissions are non-refundable. I determine what is a completed commission.
-
I have the right to decline a commission for any reason.
-
Finished commissions may be posted to other websites by the commissioner with proper credit given.
-
Unless specified otherwise, I will assume I have the right to post the commission publicly.
-
I have chronic health issues which may impact commissions at times. These conditions have no schedule and may flare up and are out of my control. You will be made aware when my health is having a flare up and I will do my best to give you an updated deadline and/or timeline if your commission is affected by my flare up.
-
At a maximum, commissions are provided a 6 week deadline but they are generally delivered in under 2 weeks. A longer deadline is provided to account for potential health flare ups.
-
I will not begin work on a commission until full payment is received OR initial payment of an agreed upon payment plan is received.
-
Payment plans of "Half upfront/half at completion" are available upon request for commissions exceeding $250 USD.
-
Prices listed are a baseline and can fluctuate above the list price based on complexity.
-
Additional characters can add separate fees that may need to be discussed depending on what is commissioned.
-
For all commission types you will receive a sketch for initial approval. If you must request changes I ask you to do it at this phase.
-
If the changes desired here require me to make a completely new sketch, there will be a 50% fee of the price paid.
⤹ (EX: If only one emote is to be changed on a commission of multiple emotes, this applies to the cost of 1 emote. 1 emote = $20 USD = $10 USD to change the emote) -
For all commission types you will receive a screenshot for final approval. Changes requested at this point may only relate to minor details.
⤹ (EX: I forgot a character’s face markings or got their eye colour wrong. I do not mind changing these types of details with no additional charge.) -
Commissions come with 2x revisions by default.
-
Further revisions will cost an additional +35% of the price, per revision.
-
Expect a turnaround time of up to 1 month. This heavily depends on my queue, the size of your commission, my health, and life circumstances. Typically a commission is done within 7 days, though this depends on my queue.
-
I update my Trello readily with estimated dates for starting and finishing a commission, but this won't always be 100% accurate as it is an ETA and may change due to my health.
-
Finished commissions will be sent in their full resolution via e-mail or via Discord Image Link or via Twitter DM unless otherwise specified. You will be provided with the pngs, as well as a link to your own google drive folder containing all of your commissioned pieces from me.
-
To use the work provided as merchandise: +200% of the base price for what is desired for merch.
-
This would be a merchandise commission and it would require me to redraw your piece, so:
-
100% (redraw) + 100% (merchandise rights) = 200%
⤹ (EX: 1 emote = $20 USD | $20 + 200% = $60 USD as the total)
-
I retain the copyrights and rights to all of my artwork.
-
This goes for all clients/commissioners and anybody who views my portfolio or promotional pieces:
DO NOT claim the artwork as drawn by you.
DO NOT trace any emote shown.
DO NOT resell any of the emotes shown/commissioned/purchased.
DO NOT alter/edit my work unless discussed.
DO NOT steal any emotes shown for your own personal use if not commissioned for you. -
Please contact me if you want to have anybody else edit the emotes I made. This could be for if you want somebody to make holiday edits or to animated emotes I made, for example. Please reach out and we can discuss this.
-
Client may commission a third party to animate the product as long as credit for the original art is provided. I would greatly appreciate it if you would like to to post your commission to your socials, and credit me on Twitch using Twitch emote attribution, if applicable. My username on Twitch is PupTea
-
I hold no responsibility and will not offer refunds for any assets that are taken down by a platform due to breaking their TOS. I will try my best to warn you before accepting a commission if it could risk a TOS with platforms such as Twitch; accepting the commission past this means you accept the risks.
⤹ (EX: A middle finger emote on Twitch risks not getting approved if you have manual emote revision or getting taken down if anybody reports it due to breaking their TOS.)
